In 2005, Kachina (the Buyer) and Lillis (the Seller) entered into a new Gas Purchase Agreement (“Agreement”). Kachina argued that the Compression Station, though pre-existing, “effects delivery” by “lowering suction” which reduced upstream pressure and aided the flow of gas into the pipeline.
